Smiths } I Thomas Smith Senr of Clark County and State of Kentucky man of
Will } 84 years and of sound and discerning mind do make the
following as my last will and testament hereby revoking any previous
codicil which I may have heretofore made after the payment of my
financial expenses and just debts I dispose of my estate which may
remain as follows to wit
I devise to my wife Judith Smith may four negroes to with Esttien
Mary Charles and Abraham to hold during her life or widowhood and
as much of my household and Kitchen furniture and stock and farm-
ing utensils including the ox cart as she may choose to keep also
to be held by her during her life or widowhood which is the whole
portion of my estate which I intend her to have
and said estate I devise and bequeath to my wife I wish at her
death to be equally divided among my children and grand children
and great grand children to wit Benjamin W Smith Martha Ragland
Charles L Smith Thomas Smith Mary Jewell Mildred Vance Thomas N
Quisenberry and Mildred Jane Quisenberry children of my deceased
daughter Elizabeth Quisenberry (said grand children to count in said
division as one person) and David H. Berry William B Berry Robt
A Berry Martha Berry Susan Berry Lucy Berry Benjamin F. Berry
John M Berry children of Mary Berry deceased another daughter
of mine and Thomas J Berry son of Thomas J Berry deceased who
was a son of Nancy Berry (my said grand children and great grand
children in said division to count as one person) and if the negroes belonging
to my estate cannot be ????? divided in kind then my executors
or other personal representatives shall be and they are hereby authorized
and required to sell said negroes and divide the proceeds thereof
among my children grad children and great grand child above
??? before and division is made as above directed my executors
are hereby required immediately after my death to pay to my grand
children the children of my deceased son David Smith to wit
Nancy Willis Smith Emily Frances Smith one hundred dollars
each in full of their portions of my estate and the residue of my
estate not devised and bequeathed to my wife as aforesaid excepting
the ??? hundred dollars bequeathed to the above named children of
David Smith I direct to be divided among my above named
children grand children and great grand children the said children
of David Smith expected as is directed in regard to the estate so
devised and bequeathed to my wife except that the division of said
residue of my estate shall take place immediately after my death
I constitute Nathaniel Ragland my son in law and Thomas Smith
my son the executors of this my last will and testament - Given with
my hand this 1st May 1837

I Thomas Smith the above named testator do hereby declare
the following to be my codicil to my will above set forth
and date 1st May 1837. It is my will that Mary Jewell
the wife of Barton Jewell shall have no part of my estate but the
portion thereof which in said will which is devised and bequeathed to her
I do hereby devise and bequeath to my said son in law Nathaniel Ragland
and my son Thomas Smith to be by them disposed of as they please
and the portion by said will devised and bequeathed to my great grand
son Thomas J Berry I do hereby devise and bequeath to him only on
the condition that it shall not vest him the the even of his attaining to the
age of twenty one years and is case he shall die before he attains to the
age of twenty on years said p0rtion shall not rest in him - but the same
shall revert to and rest in my other heirs at law before named except
said Mary Jewell who shall not receive any part hereof as witness
my hand the 16th day of June 1837

and ordered to be recorded
