James Berry Jr sold Red Bird Creek land in 1816. In the deed, he specifically guaranteed the title to any challenge by John Berry. James appears to have gotten the land from Thomas Berry Sr., of Muddy Creek, Madison County, KY. It is assumed that James was a son of Thomas. It is also assumed that John (potential title challenger) was a son of Thomas. We just need to prove all that. [ceb]

What would give John Berry the apparent standing to challenge the deed of 1816? Was it because he was also a son of Thomas Berry Sr., and because there was no documentation transferring title from Thomas Sr to James?

Is John Berry, mentioned in the deed, the same John Berry that transferred a Virginia warrant for 400 acres to Robert Barnett? If so, John may have been an older brother of James. John of this warrant could be John Berry (m. Hannah) died Lincoln County, KY., in 1792. He could be John Berry (user id 8864) that married Elizabeth Harris. Since the warrant does not specify where John lived, he could be any John Berry in any state.

Is James Jr = James W. Berry (user id 8607)? James W Berry's wife was Margaret and he was father of William G. Berry (user id 8609) and several other children. 2
