Whereas it hath appeared unto this Court this present day that Mrs. Wilkins wife of Mr. John Wilkins hath formerly made an exchange of a mayde servant with Elizabeth Berry wife of James Berry which exchange was soe made by the earnest sollicinge and much importunity of the said Mrs. Wilkins, As allsoe it hath appeared that the said Mrs. Wilkins after such her exchange haveinge receased the said Berryres mayd shee most unconscyonably and dangerousely Beate her. Anad the Former servant of the said Mrs. Wilkins which is nowe the servant of the said Berry haveing humbly petitoned unto this Court for releefe as by the same on record doth at large appe[are] It is thereupon thought fitt and so ordered by this Court that Elinor Rowe, the servant exchanged and which is nowe at the said Barryes house shall there remayne and serve her whole Indented tyme and the other servant in like manner with Mr. Wilkins and that each of their Indentures be accordingely delivered by the said Berry and Wilkins wach unto other upon the ground of the said prtition and it beinge such An equitable and considerable case.

James immigrated to Virginia from England about 1633. His name first appears in the court records on 30 Dec 1633, at a court held at Accomack, when Henry Lee was ordered to serve the full time of his indenture to James Berry. He moved to Maryland in 1652, along with his wife Elizabeth and children William, Roger and Martha, his servants and several other people, settling on Hunting Creek Hundred in Calvert County. On 24 Apr 1655 James was made a Commissioner of the Patuxent Court. Six months later on 5 Oct 1655 he was "convicted of several subscriptions against the present goverment tending to set up and abet a false and usurped power" and was to "abide in the sheriff's custody until he gave security" -- which he did. At this time Maryland was in the middle of a power struggle involving Lord Baltimore and Parliament. James and Richard Preston, his son's future father in law, were prominent in the struggle. In 1657 at a court held in Patuxent, William Berry, as son and heir of James Berry, late of Accomack (but now both of Patuxson in Maryland) confirmed his father's sale of land in Virginia in 1655, one containing 350 acres lying in Maggutty Bay, Accomack County and the other 250 acres called Gold Quarter. In 1656 William petitioned the court against John Little for "notoriously scandalizing his father and mother". Little had said that the church in which William's parents were married was burned and that James Beery "did keep a boat to runnaway with, when his wife's tother huband did come in". The court sentenced Little to stand at the whipping post for one hour and pay a fine. On 22 Aug 1657 William Silverthorne testified that he had heard "rumours of late" that Elizabeth Berry had another husband in England. William Muffett testified that he had read some depositions that Mary Little had brought with her from Accomack in the spring of 1656 that stated that James and Elizabeth had never married. After James' death a suit was filed against his estate by a woman who claimed to have married him in England. She was proven to be an imposter and sentenced to the ducking chair -- see DuBury-Berry Family by Mary Honeywell.

My information for John Berry, son of Richard Garrett Berry, comes from the book "William McConnaughey/Ellen Berry and Descendants" by Thelma Elliott, (now deceased) privately printed in 1986, no IBSN.
On pages 1-10 to 1-22 It contains a typewritten copy of an earlier handwritten copy of a letter dated 1875 by Elizabeth B. Berry.
Here she retells her family history as told to her by her parents.
This must have been taken from some earlier written record now lost.
Because it gives specific details, like the names of ships, dates of events, etc. I feel there must be some truth to it.
I have tried of provide a more readable narrative of the events in my attached document.
