To have and to hold to said William & his assigns - but to be vo id on the said J Berry's ?aying him ___ he owes him and all that e? Milli on is bound for on his acc?? in any & every way. Given under our hands a nd seals the day ____ may ______, and for the purpose afsd the Said Jam es H Berry does convey to Million all his personal ?ty and c?oses and a ct on which are liable by law for his debts. The Berry guarantee that the ir title to said land is good. It is understood James H Berry owes Wm Ber ry a sum of from five to seven hundred dollars tht he is to have a li en on the land for _____ William is indemnified and paid - and whereas Bur rell William has advanced two hundred and twenty dollars mon. to said B? ?? payable first August next. James H.
, son of James and Sarah Grubbs Berry, was born 6 December 1802. He first appears on the tax list in 1824. On 3 February 1825 James H., with his siblings, sold 18-1/4 acres on Tate's Creek, and on 12 February they sold another 18-1/4 acres.

James H. is on the 1825 tax list, paying tax on 200 acres on Tate's Creek. In November his brother William sold 100 acres adjoining the land of James H. On 3 January 1826 James H. and his mother sold 76 acres on Tate's Creek. He is on the 1826 tax list with 226 acres on Tate's Creek.

He is on the 1827 tax list, and on 4 December James H. married Emily S. Fox. He is on the 1828 tax list with land on Tate's Creek.

On 2 February 1829 James H. mortgaged 263 acres on Tate's Creek, adjoining his brother-in-law, Samuel Parrish.

James H. is on the 1830 Madison County census, age 20to 29 (1801-10), with one female age 70 to 79, who may be his mother Sarah, one female age 60 to 69 (1761-70), who may be his unmarried aunt Martha Berry, two females age 20 to 29, one of whom is probably his wife Emily, and the other may be his sister Elizabeth, who is yet unmarried, and one female under five (daughter Mary Elizabeth).

On 19 January 1831 James H. mortgaged 140 acres on Tate's Creek, and on 25 January he and Emily sold 150 acres on Tate's Creek. It appears he may have had a problem with cash flow? On 6 October 1834 James H. was appointed constable, and was to continue as constable until May 1842 when he resigned.

On 31 October 1834 James H. bought land on Tate's Creek from Barnet Turner.

James is on the 1840 Madison County census, age 30 to 39 (1801-10), with one unknown male age 60 to 69, one female (Emily?) age 30 to 39, one female (daughter Mary Elizabeth) age 10 to 14 (1826-30), one male (James T.), and one female (Susan M.) age 5 to 9 (1831-35, two males (William G. and Samuel F.), and one female (Nancy J.) under five (1836-40). His mother Sarah and brother William are living next door.

On 16 October 1841 James H. and his brother William mortgaged 110 acres on Tate's Creek where James H., his mother, and probably his brother William were living. In December 1842 James H. and brother William sold 107-1/2 acres on Tate's Creek, adjoining their mother's dower land.

In May 1843 James H. was commissioner of the revenue tax in the bounds of the 7th Regiment. On 30 September he mortgaged personal items to his mother Sarah. He was clerk of the August election in 1844, and on 4 December was again commissioner of the revenue tax.

On 6 February 1849 Shadrack Williams mortgaged personal items to James H. and Emily.
James is on the 1850 Madison County census, age 47 (1803), with wife Emily age 40, daughter Mary age 21 (1829), son James 20 (1830), daughter Susan 14 (1836), son William 13 (1837), son Samuel 10 (1840), daughter Nancy 8 (1842), daughter Lucinda 3 (1847), and James H.'s mother, Sarah 89 (1761).

In December 1852 James H. and his children, James T., William, and (Mary) Elizabeth, were buyers at the estate sale for his mother Sarah.

James H. and children, Mary E., James T., William, and Susan M. are on the 1855 tax list.

James H.'s son James T. was appointed administrator of the estate of his uncle, William Berry, on 7 December 1857, and in October 1858 James H., and sons, James T. and William G. were buyers at his estate sale.

James H. and children, Mary E., James T., William G., Susan N., and Samuel F. are on the 1860 tax list.

James H. is on the 1860 Madison County census, age 57 (1803), postmaster, with daughter Mary E. 31 (1829), daughter Susan M. 23 (1837), son William G. 22 (1838), son Samuel F. 19 (1841), daughter Nancy J. 17 (1843), daughter Lucinda N. 13 (1847), and son Charles E. 8 (1852). Son James T. is age 29 (1831), with wife Elizabeth S. 25, and their son George M. age 4 (1856).

James (should be H. - but written "T.") is on the 1870 Madison County census, age 67 (1803), with daughter Mary 40 (1830), daughter Susan 34 (1836), daughter Nancy 27 (1843), daughter Lucy 20 (1850), and son Charles 18 (1852). Son "J. T." is age 39 (1831), with wife "Lizzie" 35, their son George 14 (1856), daughter Mary 5, son Samuel 2, and (father-in-law?) Isaac Hill 76.
